Smite on Clvl or just always hit

I got a little bet with my friend, so please answer fast;)

AFAIK, Smite is always ITD and ITB (Ignore Target's Defense/Blocking). Last time I played a Vindicator was 1.09D, and clvl difference between the Paladin and the enemy was not a factor.

When Smite misses it's usually due to range issues and monsters moving during the attack.

levels factor in another part of the to hit equation that doesnt include ar and defance as factors AFAIK, so it should be dependant on it
