I'm not sure this is a problem with the Judiciary. (Edit: Actually, I'm sure it's not a problem with the judiciary.) The war on drugs, and the associated spying, is a problem of the executive branch for going to far, and the legislative for letting them. The judges can only read whether or not it is lawful. And there is a very strong conservative ideology in parts of the judiciary that does not believe there is any constitutional right to privacy whatsoever.
All the judge had to do was rule as to whether his 4th amendment rights had been violated.
