I just noticed that I can select any of the three difficulty settings, even with brand new character. Is this a Hellfire bug or a patch bug? (I'm using the newer 1.21 'fixed' patch, no mods/cheats/hacks)

That isn't a bug at all. That feature was deliberately incorporated into Hellfire.

Btw-it is only a feature which applies to single player.
